Raffle rules “1 Jurita for 10 Pounds”

1. Organiser

1.1. The Juka Britannia Consulting (Help the Others) is an Administration of artist Jurita-AGSA registered in UK in 2007 (hereinafter the Administration), a British self-employed registered in the national register under the no. 14154 30803, whose principal address is City of Westminster, London SW1.

Jurita Kalite enquiry reference no. 1-245108601 Gambling Commission, www.gamblingcommission.gov.uk  https://www.gamcare.org.uk/ to organize a charity raffle entitled “1 Jurita for 10 Pound” (hereinafter the “Raffle”) whose purpose is to raise funds to promote through the help to animals (hereinafter the “Projects”).

Promoter: Jurita Kalite, artist, Marketing and Communications of JuKa Britannia Consulting.

1.2. The Raffle is organized online on the website https://1jurita10pounds.juritaart.com (‘the Site’).

1.3. The authorized capital of the Raffle has been set at the sum of £5,000 ten thousand British Pound Sterling (GBP), consisting of 500 tickets with a unit value of £10 british pounds.
Proceeds from the Raffle, net of the costs of organizing and purchasing the Lot described in Article 2, will be allocated to the Projects according to the actual amount of funds that may have been raised by the Administration. It is specified that these fees are legally capped at 15% of the issue capital.

1.4. The Raffle is organised in partnership with the Administration of artist Jurita-AGSA.

1.5. Participation in the Raffle carries with it the full acceptance of these Regulations.

2. Lot Description

2.1. There is one Lot (prize) available to be awarded to only one randomly selected prize winner.

2.2. The Lot is an set of 5 modern original painting and drawing by Jurita-AGSA (acrylic, Watercolor on paper, signed at the down and left Jurita) from 2020 and entitled “Jazz” with an estimated value of five hundred British pounds (£500 GBP).

2.3. The certificate of Authenticity of the set of 5 paintings is deposited in the hands of artist Jurita-AGSA in London UK.

2.4. The Lot (prize) is as stated and The Lot cannot be awarded in any form other than that provided for by this Regulations.

2.5. The Lot will not be taken back, exchanged, or replaced by any other object for any cause. No cash counter-value will be awarded in exchange for the Prize won. There is no cash alternative.

3. Terms of participation

3.1. Participants.

3.1.1. The Raffle is open to any natural or legal person aged 18 years and over residing in a jurisdiction where the Raffle is permitted.

3.1.2. The Participant undertakes to provide accurate, correct and complete information: fill in your full name, address, email and telephone number and to provide the Administration with any updates regarding the personal data he has entered on the electronic registration form.

3.1.3. The Participant authorises all legal checks regarding his identity and contact information.

3.1.4. Any registration of an incomplete, unvalidated Participant with false, erroneous, illegible, incomplete, inaccurate, fanciful or undiscounted details and indications and not in accordance with the conditions set out in these Terms will be considered null and void. In this case the Administration reserves the right, without notice, to cancel Participant tickets. Any incomplete, false and/or incorrect identification or address results in the immediate elimination of the Participant concerned. In this case Participant not eligible take any action against it.

3.1.5. Administration Liability. Under no circumstances can the Administration be liable because of a Participant who would violence property right of others which he would not hold in the Raffle registration process.

3.1.6. Fraud. Any fraud or attempted fraud in this transaction by a Participant will result in the elimination of the Participant concerned and the cancellation of his tickets, without prejudice to the other penalties provided by the Penal Code and reported to the Police Department UK.

3.1.7. Promoter may prohibit any entrant or potential entrant from participating in the Prize Draw, if such entrant or potential entrant shows a disregard for these Official Terms and Conditions; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Promoter, or Promoter’s agents or representatives, including but not limited to the Prize Draw Entities; or behaves in any other disruptive manner (as determined by Promoter in its sole discretion).

3.1.8. Privacy Policy. The processing of personal data is described in the Association’s Privacy Policy.

3.2. Duration. The “One Jurita for 10 pounds” operation begins on … January 2021 at 00:00 midnight (included) and ends on … February 2021 at 24:00 midnight (not included).

3.3. Procedure.

3.3.1. Each Participant has the option of purchasing from one to ten tickets with a unit value of £10 British Pounds Sterlings (GBP).

3.3.2. Orders are limited to 10 tickets entry per person during the entire Prize Draw Period. For larger orders, please email us at jukaconsulting@gmail.com

3.3.3. Each Participant has the option out an order form specifying their surname, first name, address, postcode, city, country, email address, number phone on the Site https://1jurita10pounds.juritaart.com

3.4. Payment.
3.4.1. The payment of the ticket is made online by payment card, PayPal, by Bank Transfer via a secure payment platform.

3.5. Ticket delivery. Once the payment has been made, the Participant will receive an email mentioning the ticket number(s) and confirming his participation in the draw that will take place as stipulated in Article 3.2.1, as well as instructions to transfer one or more tickets if they wish to offer them to a third party.

3.6. Draw

3.6.1. The draw will take place online on 27 February 2021 and will be carried out in the study of Lady Ju Gallery in London.

3.6.2. At the end of the Draw Period, the winner will be randomly selected by the artist Jurita-AGSA using a computer process producing verifiably random results under the supervision of an independent third party. It will be broadcast live on our website live.

3.6.3. Subject to the above, the Promoter‘s decision concerning the determination of the prize winner shall be final and binding.

3.7. Designation of the winner.

3.7.1. All ticket numbers will be drawn in succession.

3.7.2. The winner of the Raffle will be the subscriber of the ticket drawn.

3.7.3. The winner will be notified by email and by registered mail to your billing address, with notice of receipt to the contact information provided when registering for the raffle online, as well as the logistics for the retrieval of the Lot.

3.7.4. The winning ticket number will be posted on our website.

3.7.5. The Administration cannot be held liable due to a subsequent change of address of the Participant.

3.8. Change of winner.

3.8.1. In the absence of a response from the winner within one (1) month, or lack of receipt of the additional personal data that the winner has consented to provide by accepting the privacy policy at the time of purchase within one (1) month, or following the withdrawal of the winner’s consent for the passage of some of his personal data into the public domain, the designated winning ticket will be cancelled.

3.8.2. In the event the claim for a prize is not received by the Promoter within one (1) month of notification, the Promoter reserves the right to select an alternative winner and the subscriber of the second randomly drawn ticket will be designated as the winner.
The same notification process will be used for the second random ticket and the same conditions for changing the winner will be applied, and so on.

3.9. Terms of retrieval of the Lot

3.9.1. Collecting and sharing your personal information if you are the winner. We will require from you: – a copy of a government issued photo ID; – your date of birth; – your profession. We might also require additional information to arrange for the shipment.

3.9.2. Once you have received the painting, we require that you send us a photo of yourself holding or standing next to the painting.

3.9.3. The Lot will be retrieval by two way depend of the winner request: collected by winner directly from the warehouse or shipped via recorded delivery.

3.9.4. The Lot will be removed by the winner, either directly from the warehouse in which the painting is currently stored, or at the Administration’s headquarters within the deadline agreed with the Administration.
The winner will have to make all necessary arrangements to recover the Lot according to the agreed terms or appoint an agent to that effect.

3.9.5. The prize will be delivered via recorded delivery to the winner’s home address and will only be fulfilled if the Promoter is given the entrants’ full and accurate postal address.

3.9.6. Please allow 28 days for delivery after prize claim being received. 

3.9.7. Shipping expenses, taxes, including VAT, customs duties if applicable, insurance etc. will be paid by the Administration up to 50% (fifty percent) of the purchase value of the painting.
Beyond this limit, they are the responsibility of the winner.

3.9.8. The value of the lot is given as an indication on the basis of the estimates and its purchase value and the Association cannot be held responsible for that value or a change in that value.

3.10. Fraud. Any fraud or attempted fraud in this transaction by a Participant will result in the elimination of the Participant concerned and the cancellation of his tickets, without prejudice to the other penalties provided by the Law UK.

3.11. Personal data. In accordance with the GDPR, the processing of personal data is described in the Administration’s Privacy Policy.

4. Special constraints related to the internet that may affect participation in the online Raffle

4.1. Participation in the online Raffle involves the knowledge and acceptance by any Participant of the characteristics of the Internet, including functional characteristics, technical performance, problems related to connection and/or access to the Internet and/or Site, network availability, network failure or saturation, transit time, access to information posted online, response times to view, the risk of interruption, the lack of protection of certain data against possible hijacking or hacking and the risk of contamination by possible viruses circulating on the network – for which the Administration cannot be held responsible.

4.2. The Administration cannot be held responsible for: delays or errors in the transmission of data that are beyond its control, sending an email or correspondence to an erroneous or incomplete or incomplete email or physical address.

4.3. The Administration cannot be held responsible for: In case one or more Participants cannot connect to the Site due to any technical defects or problems related to network congestion, if, for any reason, the Participant’s connection to the Site was to be interrupted or if its participation was not taken into account because of maintenance or malfunction of the Raffle’s servers, online payment platform, telephone line or any other technical connection.

4.4. Administration are not responsible for telecommunications, network, electronic, technical or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Terms and Conditions; for any human or electronic (including but not limited to programming) error; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, illegible or returned.

4.5. Furthermore, the Association cannot be held responsible for any damage, of any kind, caused to the Participants, their computer equipment and the data stored there, and the consequences that may result on their personal, professional or commercial activity.

4.6. The connection of any person to the Site and participation in the Raffle is under their full responsibility. It is therefore up to any Participant to take all appropriate measures in order to protect his own data and/or software stored on his computer equipment from any infringement due to acts of external malice, including viruses.

4.7. In all cases, if the proper administrative and/or technical process the operation is disrupted by a virus, computer bug, unauthorized human intervention or any other cause beyond the association’s control, the Association reserves the right to interrupt the operation.

4.8. By entering this Prize Draw, entrants agree to be bound by these rules and by any other requirements set out in the promotional material.

5. Cancellation and Postponement

5.1. The Administration reserves the right, if circumstances require it, cancel, modify or suspend the Raffle, shorten it, extend it, postpone it, change its terms or change the location of the draw without any liability being incurred as a result, for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Terms and Conditions).

5.2. In the event of cancellation, modification or suspension, etc. Administration reserves the right to select winners in a random drawing from among all eligible, non-suspect entries received prior to the time of the event warranting such cancellation, modification or suspension.

5.3. In particular, the Administration may cancel or suspend all or part of the transaction if it appears that fraud has taken place in any form, including in the context of participation in the Raffle and/or in the event of a misinformation by the Participants. It reserves, in this case, the right not to award the endowment to the fraudster (s) and/or to prosecute him in the Courts UK.

5.4. The Draw can only be made on the condition that, on the date of the draw and after deducting the price of the painting and the costs incurred up to that date by the Association, a minimum sum of 100 british pounds (one hundred british pounds) will be donated to charity by the Administration.

5.5. This Raffle may also be cancelled in the event of a case of force majeure, as usually defined by the jurisprudence of the courts UK, without the Participants or winners being entitled to claim any compensation to the Association, other than what is provided for in Article 5.7 below.

5.6. In the event that the Association decides to cancel the Raffle for any reason, each Participant will be notified of the cancellation by email.

5.7. In the event of cancellation, the association undertakes to refund the price of the tickets paid by each participant within one month of notification of the cancellation of the Raffle by email. The refund will be made by credit on the bank card used to make the initial payment.

5.8. In any event, the Administration cannot incur any liability as a result of the cancellation of this transaction.

6. Intellectual property rights. The Site, elements of any kind be it components of the Site, the graphic chartre of the Site, the trademarks and logos are the exclusive property of the Administration or its partners who hold all the rights to intellectual and industrial property. Any reproduction, representation, adaptation and/or exploitation, total or partial, of the Site are strictly prohibited, without written prior permission from the Association. The Association grants a free, personal, non-exclusive and non-transferable right to access and use the Site for the purposes of the Raffle.

7. Evidence, Conservation and Archive. Electronic records, including emails, kept in the systems of the Administration (or service providers) will be considered as systems of record. It is agreed that in the event of a discrepancy between the Administration’s electronic documents folder (or its providers) and the paper documents available to the Participant, the electronic records of the Administration will prevail.

8. Settlement Filing

8.1. This Rules was filed with witnesses in London.

8.2. Raffle Rules are available free of charge on the Site https://1jurita10pounds.juritaart.com

8.3. It may also be sent free of charge, by mail, to anyone who makes the electronic written request at: jukaconsulting@gmail.com.

8.4. To receive a free copy of the Rules, the Participant will have to provide, in a clear and readable way, on free email his complete contact details (name, first name and postal address).

8.5. Only one claim per Participant will be granted during the entire period of the “one Jurita for 10 pounds” operation.

9. Rule Changes

9.1. Additives and regulatory changes that may be made during the duration of the transaction within the limits set out in the Order authorizing the Raffle (or any new orders made later about the Raffle) will be published on the Site. They will be considered endorsements to this Regulations that are in agreement with the latter. Participants are therefore advised to log on to the Site on a regular basis to learn about any changes to these Regulations.

9.2. Amendments to this Full Regulations are deemed to be accepted in the same terms as the original version of this regulation.

10. Applicable Law and Jurisdiction. This Regulation is governed by Law UK. Any dispute or challenge relating to the performance or interpretation of these Regulations will be submitted to the competent Tribunals UK.
